Most veterans avoid mental health claims because they think it'll cost them their firearms, custody of their children, or their job.

The truth:

Mental health ratings are simply checking boxes on symptoms. There's no difference between 10% Mental Health and 100% Mental Health in terms of your freedoms. You can still work, own firearms, and have custody of your children.

Range of Motion: You're Rated On Your Worst Day

Not Your Average Day. Your Worst Day.

The VA rates you on normal, happy, comfortable range of motion. Not "I can tough it out" range of motion.

Example: If your shoulder hurts constantly but you can still reach up to grab cereal from the top shelf, that's not free range of motion. On your worst day, how far can you raise your arm with zero pain?

That's what matters.

The Truth About Radiculopathy

If You Have Back Pain, You Probably Have Radiculopathy

Numbness, burning, tingling sensation down your legs and feet? That's radiculopathy. It's rated separately from your back.

Your back alone might be rated at a certain level. But radiculopathy down each leg could be rated separately. Most veterans don't know this exists.

A NEXUS letter is a medical-legal document that establishes the connection between your current condition and your military service.

When you need one:

  • Your service connection isn't obvious in records
  • Your condition developed after leaving service
  • You've been previously denied
  • The VA says "insufficient evidence"

What Is A DBQ?

The Standardized Form That Determines Your Rating

A Disability Benefits Questionnaire (DBQ) is what the VA uses to assign your rating. The difference between proper and improper completion can mean the difference between significantly different ratings.

The Simple Question:

Does your headache cause you to not feel 100%?

If yes, that's incapacitating.

You only need three or more incapacitating episodes per month to qualify for a significant rating. Most veterans are severely underrated for this.

Knees: You Should Have Two Ratings

Per Leg
Flexion Extension

If you have a knee rating but not two ratings per leg (flexion and extension), something's wrong.

Even if one is rated at zero, that tells us the evaluation was complete. If you only have one rating total, your C&P exam was incomplete.

Elbows: Three Ratings Per Arm

1 Flexion
2 Extension
3 Supination

Your elbows are rated on three different movements. That twisting motion when you rotate your palm? That's supination.

Do you have three ratings for each elbow? If not, your evaluation was incomplete.

Sleep Apnea & PTSD Connection

📊

Veterans diagnosed with PTSD are significantly more likely to develop sleep apnea.

PTSD Sleep Apnea

This means sleep apnea can be connected as secondary to PTSD. But you need to know the case law and have the right medical literature to prove it.

The 4-Step Service Connection Process

Medical Documentation

Any medical record from any provider. Military, VA, private, civilian. All that matters is you have documentation.

Diagnosis

You need an official diagnosis in black and white. No diagnosis = no rating.

Your Story

Your testimony about what happened. Be consistent. Pick one incident and stick with it.

Examination

The only step you can't fully control. But if you have steps 1-3, you still have a strong chance even with a bad exam.

What Happens After You Get Denied

You have options:

Option 1

Supplemental Claim

Submit new medical evidence addressing the VA's concerns in your decision letter.

Option 2

Higher Level Review

Request a senior reviewer examine your case. "I want to speak to a manager."

Option 3

Appeal

Take the VA to court. Only recommended as last resort. Attorney representation highly encouraged.
